Does the Defence Delivery Agency instrument expire the day after it starts?
The amending instrument is repealed on 2 July 2027 under Legislation Act 2003 section 48A, because it only amends another instrument. The clause 8 it inserted continues in the PGPA Rule, which does not sunset.
The repeal and the effect are different things. Legislation Act 2003 section 48A automatically repeals an instrument that does nothing but amend or repeal another instrument. F2026L01074 is that kind of instrument. It starts on 1 July 2027 and is repealed at the start of 2 July 2027.
Does the DDA stop being a listed entity?
No. The amendment has already changed the PGPA Rule. Clause 8 sits in Schedule 1 of the Rule and continues to apply after the amending instrument is gone. The explanatory statement says sunsetting does not apply to the PGPA Rule, so the continued clause 8 has no sunset date.
Why the register looks alarming
The Federal Register status history shows a future repeal of F2026L01074 on 2 July 2027. A reader who stops there may conclude that the DDA status lasts one day. The register is recording the life of the amending instrument, not the life of the amendment.
How should a citation read after 2 July 2027?
Cite the compiled PGPA Rule, Schedule 1, clause 8, with the compilation number. Cite F2026L01074 only as the instrument that made the change. That is also the citation the annual report and the corporate plan should use.
What should the watch check?
The PGPA Rule compilation, not only the amending instrument. A later compilation could move or amend clause 8, and a later amending instrument could change the accountable authority, the officials or the purposes. The watch checks the compilation, the instrument and the status history.
