The requirement, in our words

Item 1 of Schedule 1 to the amending instrument inserts clause 8 after clause 7 in Schedule 1 to the PGPA Rule. Clause 8 has two subclauses. Subclause (1) says, under the finance law, that the DDA is designated a listed entity, that the National Armaments Director holds the accountable authority role, which people are officials, and what the entity purposes include. Subclause (2) defines two terms used in the clause. The insertion is the whole operative change; the other sections only name the instrument, set its start date, state its authority and give effect to the Schedule.

What the provision is doing

The insertion puts the DDA inside the Commonwealth resource management framework as a non-corporate Commonwealth entity of its own in the Defence portfolio. It achieves that by adding the body to the list in Schedule 1 of the Rule, not by creating a new Act or a fresh set of duties. The duties come from the PGPA Act and the rest of the Rule, which is why the explanatory statement points to Act sections 15 to 19 and 25 to 29.

What good practice looks like

Open the compiled PGPA Rule and find clause 8 in Schedule 1.

What changed

There was no clause 8 before this instrument. Clause 7 and the earlier clauses of Schedule 1 continue. The new clause sits in the same Schedule as the other listed entities, so the DDA is read alongside them when the Rule is compiled. The amending instrument itself is repealed the day after commencement under Legislation Act 2003 section 48A, but the clause it inserted remains part of the Rule. That distinction is the one most likely to be missed in a first reading.

Common gaps

  • The team reads the amending instrument only and cannot find the current text after the repeal date.
  • The insertion is described as creating a new agency, when the agency is established under the Public Service Act and the Rule only gives it listed entity status for the finance law.
  • The compiled Rule is not checked, so the team does not see clause 8 in its final context.
  • No one records the amendment trace, so a later reviewer cannot tell where the clause came from.

What to do before 1 July 2027

  1. Open the compiled PGPA Rule and find clause 8 in Schedule 1.
  2. Write the amendment trace from item 1 to the compiled clause.
  3. Record the review of the continued effect after the amending instrument is repealed.
  4. Give the trace to the person drafting the entity register and the accountable authority brief.
