The requirement, in our words

Section 1 gives the instrument its name. Section 2 is a table: every provision starts on 1 July 2027, and column 3 repeats that date for information only. Subsection 2(2) says column 3 is not part of the instrument and may be edited in a published version. There is no staged start, no later date for one provision and no condition tied to another event. The date is printed in the text; it is not worked out from registration.

What the provision is doing

One start date gives the DDA, the Department of Defence and the portfolio a single planning date. Every consequence then begins together: the listed entity status, the accountable authority role, the officials and the purposes arrive on the same day instead of being phased in.

What good practice looks like

Quote section 2 in the briefing note and attach the commencement page of the authorised version.

What changed

Before 1 July 2027 the PGPA Rule does not contain clause 8. The DDA is not a listed entity under the Rule, the National Armaments Director is not its accountable authority for the finance law, and the listed persons are not its officials. On 1 July 2027 all of that changes at once. A team that reads only the amending instrument can miss that the amendment is the insertion of a clause into another instrument, and that the inserted clause is what continues after the amending instrument is repealed.

Common gaps

  • The team plans to the registration date, 18 August 2026, instead of the commencement date.
  • The commencement table is read as a calculation and someone tries to add a period to registration.
  • The note gives 1 July 2027 as the start date but does not say what applies the day before.
  • The plan has no owner for the first-day evidence pack.

What to do before 1 July 2027

  1. Quote section 2 in the briefing note and attach the commencement page of the authorised version.
  2. Write the two-column test: what applies on 30 June 2027 and what applies on 1 July 2027.
  3. Work back from 1 July 2027 and put a date and an owner on every day-one document.
  4. Check the note again after any later compilation or amending instrument.
