The requirement, in our words
Section 3 states the authority: the instrument is made under the PGPA Act 2013. Section 4 is the machinery provision. It provides that an instrument named in a Schedule is changed or repealed by the items that apply to it, and that every other item has effect according to its terms. Schedule 1 names the PGPA Rule 2014, and item 1 of that Schedule inserts clause 8 after clause 7 in Schedule 1 to the Rule.
What the provision is doing
The authority section matters because the power to prescribe a listed entity, its accountable authority, its officials and its purposes comes from the PGPA Act and is exercised through the Rule. The schedules section matters because the operative change lives in the Rule, not in the amending instrument. A reader who wants the current text has to read the compiled Rule.
What good practice looks like
Put the amending instrument, the explanatory statement, the compiled Rule and the Act on one source register.
What changed
The instrument does not stand alone as a code. It is a short amending instrument whose effect is felt through the Rule. That is why the explanatory statement describes the amendment as prescribing a new listed entity and why the Federal Register will show the amendment folded into a later compilation of the Rule. The amending instrument is also subject to automatic repeal because its only effect is to amend another instrument.
Evidence an auditor or portfolio reviewer asks for
| Category | Record to keep | Retention |
|---|---|---|
| Source register | A source register that lists the amending instrument, the explanatory statement, the current PGPA Rule compilation and the PGPA Act, with the date each was retrieved. | Current, with each superseded version kept. |
| Compilation check | A record of the compilation number and compilation date of the PGPA Rule that the team read, and the check that it is the latest compilation. | Current, plus the prior compilation. |
| Citation guide | A short citation guide for the team: cite the Rule clause for the operative provision and the amending instrument for the change. | Current. |
Common gaps
- The team cites the amending instrument as if it were the current rule and never opens the compiled Rule.
- The compilation number is missing from the brief, so nobody can tell which text was read.
- The authority section is quoted but the power in the PGPA Act is not identified.
- A later compilation is published and no one checks whether clause 8 has moved.
What to do before 1 July 2027
- Put the amending instrument, the explanatory statement, the compiled Rule and the Act on one source register.
- Record the compilation number and date and check the register for a newer compilation.
- Agree the citation convention before any paper goes to the accountable authority.
- Add the register to the monthly change watch.
