The Art of Service ยท Commonwealth governance PGPA Defence Delivery Agency Checker The Defence Delivery Agency instrument, clause by clause, with the date, the duty and the evidence.
Answer

Who is the accountable authority of the Defence Delivery Agency?

The National Armaments Director. Clause 8(1)(b) names the office, and the explanatory statement says the general duties in PGPA Act sections 15 to 19 apply to it. The Director may delegate under section 110, but not the general duties themselves.

The instrument uses the office, not a person name. Clause 8(1)(b) gives the accountable authority role to the National Armaments Director. The PGPA Act provides that a listed entity has as its accountable authority the person or group the rules prescribe, so the Rule and the instrument work together.

Which duties come with the office?

The explanatory statement points to sections 15 to 19 of the Act. They require the authority to govern in a way that promotes proper management and use of public resources, achievement of the entity purposes and financial sustainability; to establish and maintain risk oversight and internal control systems; to encourage cooperation; to consider risks and effects when imposing requirements on others; and to keep the Finance Minister, along with the responsible Minister, informed.

What can be delegated?

The Director may delegate powers, functions and duties to an official in a non-corporate Commonwealth entity under section 110. The section excludes the general duties, the power to issue accountable authority instructions, the application of government policy, the corporate plan, the performance records and statements, and the financial reporting duties. The delegations instrument should list what is delegated and what is not.

Is the Agency Head the same person?

Not necessarily. The DDA is established as an Executive Agency under the Public Service Act 1999, and the Agency Head is a separate statutory office. If the two roles sit with different people, the entity has two instruction chains and the role map must say so.

What evidence should exist?

The appointment record, the entity register entry, the signed accountable authority instructions, the delegation instrument and register, the section 19 reporting protocol and the risk and control frameworks. The kit lists them with an owner column.
