Answer

Who are the officials of the Defence Delivery Agency?

The National Armaments Director, APS employees who assist the Director, ADF members assigned to the Director, and people from other Commonwealth entities or Commonwealth companies assigned to the Director. Act sections 25 to 29 apply to them.

Clause 8(1)(c) lists four groups. The first is the National Armaments Director. The second is APS employees who assist the Director. The third is ADF members assigned to the Director. The fourth is people from other Commonwealth bodies, and staff of Commonwealth companies, whose services are assigned to the Director.

Why the fourth group matters

A person can be an official of the DDA for the finance law while remaining employed by another entity. That is the point of the class. The secondment or service arrangement should identify the DDA and the Director, and the person should be on the officials register even though the home entity still employs them.

Which duties follow?

The explanatory statement says Act sections 25 to 29 apply. Those are the duties of care and diligence, honesty and good faith, proper use of position, proper use of information and disclosure of material personal interests. The accountable authority instructions and the training programme should reach every official.

What about the public interest disclosure scheme?

That is a separate Act, not clause 8. The Agency Head is the principal officer for the Public Interest Disclosure Act 2013 and needs written procedures, authorised officers and training. The record names it as a day-one task because a new entity with three inherited workforces will face disclosures early.

What evidence should exist?

An officials register with the class, the engagement or assignment basis and the dates; the secondment and ADF arrangements; the briefing records; the interests register; and the public interest disclosure procedures. The kit carries them as separate evidence rows.
